Booking & Cancellation Terms

1. Who we are and scope
These Booking & Cancellation Terms apply to reservations made with Vibrations Inc., operating as Vibrations Dive Center (“Vibrations”), for recreational dives, Discover Scuba Diving, refresher activities, PADI courses, snorkeling trips and any other activity or service expressly identified in the booking confirmation. They are separate from medical questionnaires, liability releases, PADI forms and the Privacy Policy. Completion of one document does not replace another.
The booking confirmation identifies the participant, activity, date, meeting or start time, price, required initial payment and confirmation deadline. Clearly stated booking-specific information supplements these Terms and prevails where appropriate, subject to applicable law.
2. Individual acceptance and minors
Each adult participant must accept these Terms for each booking, even when another person makes the payment. A payer and a participant may be different people.
For a participant under 18, a parent or legal guardian must accept and sign, state their full name and relationship to the minor, and confirm that they have authority to act for the minor. Activities later added to the same booking are covered by the existing acceptance unless the commercial terms change materially. A new booking or a substantial change requires a new acceptance.
3. Provisional reservations, confirmation and expiry
A reservation is Pending confirmation until the required Terms have been accepted and the required payment has been recorded as received. Only then is the participant’s place Confirmed.
Unless Vibrations states otherwise, payment is due within 24 hours after the confirmation request is sent. For a request made less than 24 hours before the activity, staff may set an appropriate shorter deadline. Vibrations may extend a deadline at its discretion.
The exact deadline shown in the booking confirmation or participant portal applies. The confirmation period starts when Vibrations sends or activates the confirmation request. If the deadline expires, the status becomes Confirmation expired, the place is no longer guaranteed and may be released. Vibrations may reopen confirmation after checking availability.
4. Daily activity reservation deposits
Fun Dives, Discover Scuba Diving and Refresh activities require a PHP 1,000 reservation deposit per participant for each reserved calendar day. A reserved activity day may include more than one activity on the same date without automatically creating a second daily deposit.
A participant who does not yet know how many days they will dive may reserve days progressively. Each additional day becomes secured when its deposit is received. All deposits are deducted from the participant’s final bill.
Vibrations may allow an open balance covering up to two completed activity days. This is a maximum operational allowance and not an automatic credit entitlement. Any interim balance is payable when requested, and further activities may be suspended until payment is received unless a manager approves another arrangement.
5. DSD digital registration
The PHP 1,000 DSD deposit includes a PHP 400 digital registration component. That component becomes committed and non-refundable once the participant registers through Vibrations’ PADI link.
If an eligible early cancellation occurs before registration, the full deposit may be refunded or transferred. After registration, only the uncommitted reservation portion is eligible, while the participant retains the digital access. For a late cancellation or no-show, the full deposit is retained.
Once the instructor-led DSD activity has begun, the full activity price remains due if the participant chooses to stop or does not complete the activity because of fear, discomfort, loss of interest or a change of mind. A participant, including a minor, may always choose to stop; a parent or guardian should not pressure a minor to continue. That decision does not make the activity refundable.
This does not remove the medical exception or remedies where Vibrations cancels or fails to provide the activity. If Vibrations cancels the DSD, the participant may choose a free reschedule or a full refund, and Vibrations absorbs any committed digital cost.
6. Course initial payment
A PADI course requires the Course Initial Payment stated in the booking confirmation. This consists of the applicable Digital Training Materials Fee plus a PHP 2,000 Course Reservation Deposit. The exact initial payment and its components are shown before acceptance.
Before digital materials are assigned, both components follow the applicable cancellation rules. Once the materials are assigned, the Digital Training Materials Fee shown in the booking confirmation is non-refundable because the participant retains the materials and may use the training record or referral where PADI standards allow.
The remaining course balance must be paid before the first practical training session unless Vibrations has approved a written alternative arrangement.
7. Cancellation windows and notice
Daily activities may be cancelled or rescheduled without loss of the reservation component when Vibrations receives notice more than 24 hours before the exact scheduled start time. Courses use a 48-hour window before the first course day.
Notice is considered received when it reaches Vibrations through the official WhatsApp number, official email address, or directly at the dive center. An unanswered call without an identifiable message is not sufficient notice. All deadlines use Philippine local time (Asia/Manila).
For an eligible early cancellation, the participant may choose a refund or one free reschedule, subject to availability and to the treatment of digital materials already committed.
8. Late cancellations, rescheduling and no-shows
For a cancellation or reschedule inside the applicable 24-hour or 48-hour window, the reservation component is retained and a new reservation deposit is required for a new date. Digital materials that remain valid are not charged a second time.
A participant is a no-show when they fail to arrive by the required meeting time, do not notify Vibrations early enough, or arrive too late or insufficiently prepared to participate without delaying departure or compromising the activity.
There is no fixed grace period. The guide, instructor or operations manager decides whether safe and reasonable participation remains possible.
9. Medical exception
For a genuine temporary medical inability arising too late for a refund, the reservation component may be transferred once to a new date for the same participant, subject to availability. The credit is valid for 12 months from the original activity date.
Committed digital costs remain non-refundable and are never charged twice while still valid. Vibrations may request reasonable supporting evidence, particularly for courses, repeated requests, high-value claims or long-term incapacity. Detailed diagnostic information is not required.
For a medically confirmed long-term or permanent inability to dive, Vibrations refunds unused service and reservation portions, while digital materials already assigned remain non-refundable. Failure to obtain a required medical clearance by the deadline normally follows the late-cancellation rule, although Vibrations may consider the circumstances.
10. Cancellations or changes by Vibrations
If Vibrations cancels an activity before it begins, the participant may choose a free reschedule, subject to availability, or a refund for the service not provided.
If Vibrations cancels a DSD, Vibrations absorbs any committed DSD digital cost and offers a full refund if the participant does not reschedule. When Vibrations cancels a course for reasons attributable to Vibrations, Vibrations absorbs committed digital costs and offers a full refund if the participant does not reschedule.
For force majeure or an event outside Vibrations’ reasonable control after course materials have been assigned, a free reschedule is preferred. If the participant declines, unprovided service and reservation portions are refunded, while the Digital Training Materials Fee shown in the booking confirmation remains non-refundable because the participant retains the materials.
If only part of an activity is not provided for an operational, weather or safety reason not caused by the participant, Vibrations offers a proportional reschedule, credit or refund for the unprovided portion.
11. Operational and safety decisions
Sites, boats, schedules, guides or instructors may change because of weather, safety or operational needs. A reasonable change is not a cancellation when the service remains safe and substantially equivalent.
Visibility, currents, weather and wildlife encounters cannot be guaranteed. The absence of a particular animal or conditions differing from expectations is not by itself a failure to provide the service.
The guide, instructor or operations manager may modify, interrupt or refuse participation when reasonably necessary for safety or training standards. Financial treatment depends on whether the cause is external or attributable to the participant.
12. Participant responsibilities
Participants must provide accurate and complete identity, age, certification, experience, last-dive, medical and emergency-contact information; arrive at the stated meeting time; follow safety instructions; and present required documents and approvals.
A participant who is ill, under the influence of alcohol or drugs, dangerously fatigued, behaves unsafely, withholds safety-relevant information, refuses instructions, or lacks a required certification or medical clearance may be excluded. When the cause is attributable to the participant, the late-cancellation or no-show rule normally applies.
If the participant’s actual ability or recent experience does not safely match the booked activity, Vibrations may propose a different activity, Refresh, additional supervision or training. The price is adjusted to the service accepted. Refusal on arrival does not normally make the reservation component refundable.
13. Courses and certification
Course dates reserve consecutive instructor capacity. A participant-caused absence or late change may require a new deposit and reasonable additional instructor-day charges, disclosed before rescheduling. Certification is earned by meeting the required performance standards and is not guaranteed by payment or attendance.
If additional training is needed, the instructor explains the available options and any cost before arranging extra sessions. Once practical training has begun, the course fees remain due and are non-refundable if the student voluntarily stops or withdraws because the instructor and scheduled capacity have been committed. This includes stopping because of fear, discomfort, loss of interest or a change of mind.
A student, including a minor, may always choose to stop; a parent or guardian should not pressure a minor to continue. That decision does not reduce the amount due or make the course refundable. Digital materials remain with the student, and free referral documentation will be provided for training successfully completed where standards permit. This does not remove the medical exception or remedies for cancellation or failure to provide the course by Vibrations.
If required eLearning is not completed by a clearly communicated deadline despite timely access and reminders, the resulting reschedule is treated as late: the PHP 2,000 Course Reservation Deposit is retained and a new PHP 2,000 deposit is required. This does not apply when the delay is caused by PADI or Vibrations.
14. Equipment
Equipment sizes submitted online are provisional and are confirmed at the dive center. Vibrations may change a size or model for comfort and safety. Vibrations inspects and maintains its rental equipment under its operating procedures.
Before entering the water, each participant is responsible for personally checking the assembly, configuration, fit and apparent function of all equipment they will use, participating fully in the standard pre-dive safety check or buddy check, and immediately reporting any concern or requesting an adjustment or replacement. A participant must not enter the water with equipment they believe may be incorrectly assembled, unsuitable or not functioning properly.
Vibrations will examine reported concerns and adjust or replace rental equipment where reasonably necessary. This participant check does not remove Vibrations’ responsibility for proper maintenance or for defects attributable to Vibrations.
Participants must use rental equipment reasonably and report problems immediately. Normal wear and failures not caused by the participant are not charged. Loss or damage caused by negligence, misuse or disregard of instructions may be charged at a reasonable repair or replacement cost. Participants using personal equipment remain responsible for its condition and suitability. Vibrations may refuse equipment that appears unsafe and offer rental equipment at the applicable rate.
15. Payments, final bills and refunds
Payments are recorded in PHP. The customer must initiate the exact requested amount. Customer-side bank, transfer and currency-conversion fees are borne by the customer; merchant fees deducted from Vibrations by its payment provider are absorbed by Vibrations, and the customer receives credit for the nominal amount paid.
Daily-activity deposits are allocated to the participant and reserved date and deducted from the final bill. A single payment may fund several participants, but Vibrations records a separate allocation for each participant and date. An electronic payment that is only initiated or pending does not confirm a place until received or reasonably verified. Cash payments are recorded and a receipt or confirmation is provided.
Approved refunds are initiated for the approved gross PHP amount within 14 business days. The receiving bank or provider may deduct fees or apply exchange rates outside Vibrations’ control. Refunds normally return to the original payer or payment method; another destination requires the payer’s written request and manager approval.
“Business day” means Monday to Friday, excluding Philippine public holidays.
16. Outstanding balances, credits and prices
Any balance for a service already provided remains due. Vibrations may suspend further activities when a prior balance is unpaid or the two-day open-balance limit has been reached, unless a manager approves an arrangement. A reversed or disputed payment becomes due again unless the dispute concerns a valid refund, non-provision of the service or another remedy available under these Terms or applicable law.
Credits are normally valid for 12 months from the original activity date and do not guarantee a particular date. Medical credits are personal. Weather or Vibrations-cancellation credits may be transferred with manager approval; other transfers are discretionary. An expired credit is normally non-refundable, but Vibrations may extend it where the customer tried to book and no suitable availability existed.
The confirmed booking price applies to that booking. Later promotions do not alter it, and later additions use the price applicable when added. Prices are in PHP.
17. External services, force majeure and personal property
PADI, payment providers and other external services may experience outages outside Vibrations’ control. Vibrations will provide reasonable assistance and extend a deadline when the problem clearly comes from the platform.
Force majeure includes severe weather, natural disaster, government closure, major transport interruption, epidemic or another event reasonably outside Vibrations’ control. Remedies for unprovided services follow these Terms, without additional compensation except where applicable law provides otherwise.
If an official transport suspension, natural disaster or comparable event prevents a participant from reaching Siquijor while Vibrations remains able and willing to provide the booked service, the normal early-cancellation rules apply when timely notice is given. If the event arises inside the applicable cancellation window, Vibrations will offer one free reschedule or a credit for the same participant, valid for 12 months and subject to availability. Digital materials already assigned remain non-refundable and are not charged again while still valid. If the participant chooses not to use the offered reschedule or credit, this does not make the booking refundable.
Vibrations is not responsible for losses relating to travel, accommodation or transport booked separately by the participant, except to the extent directly caused by Vibrations’ fraud, bad faith or negligence, or where Philippine law otherwise provides. Vibrations takes reasonable care, but participants remain responsible for personal property. Vibrations is not responsible for loss or damage unless directly caused by Vibrations’ fault or negligence. Dive and travel insurance covering cancellation, accident, hyperbaric treatment and evacuation is strongly recommended.
18. Communications and personal data
Participants must provide valid contact details and notify Vibrations of changes. Reminders are a courtesy; missing a reminder does not remove a deadline clearly stated in the confirmation or portal, provided Vibrations can show that the initial link and deadline were communicated.
Booking acceptance does not authorize marketing. Personal data is used for booking administration, safety, payments, legal obligations and training. A separate Privacy Policy explains lawful bases, retention, rights and necessary sharing with providers such as PADI and payment services.
19. Electronic acceptance and general provisions
Electronic acceptance records the Terms version, accepted text or integrity reference, date and time, signer identity and capacity, booking or walk-in reference, channel and signature reference. Staff may assist technically but cannot accept for a participant unless legally authorized.
These Terms are governed by Philippine law. The parties will first try to resolve a concern directly and in good faith. Any unresolved dispute will be submitted to the competent authorities or courts under applicable Philippine law.
If one provision is invalid, the remainder continues to apply. A one-time exception does not permanently waive a rule. Problems should be reported as soon as reasonably possible so Vibrations can try to resolve them during the activity; this does not reduce statutory consumer rights.
